Welcome to QuoteDeck. This Terms of Use Agreement ("Agreement") is a legally binding agreement between you ("User", "you", or "your") and QuoteDeck ("QuoteDeck", "we", "us", or "our") regarding your use of the QuoteDeck website, software, application, and related services (collectively, the "Platform"). By accessing or using the Platform, subscribing to our services, or clicking "I agree", you agree to be bound by this Agreement and our Privacy Policy, which is incorporated herein by reference.
PLEASE READ THIS AGREEMENT CAREFULLY. It contains arbitration and class action provisions that may affect your rights. If you do not agree with any part of this Agreement, you must not access or use the Platform and must cease use immediately.
To access certain features of the Platform, you may be required to create an account. When creating an account, you agree to:
You agree to notify QuoteDeck immediately of any unauthorized use of your account. QuoteDeck will not be liable for any losses incurred as a result of unauthorized access to your account.
Upon registration and payment, QuoteDeck grants you a limited, non-exclusive, non-transferable, and revocable license to use the Platform. Your access is personal to you and may not be shared, transferred, or assigned to third parties. We reserve the right to revoke access if you violate this Agreement.
QuoteDeck provides tools for insurance professionals to manage quotes, client intake forms, and package customization.
Disclaimer: QuoteDeck is a software platform only. We are not an insurance company, broker, or agent. Quotes and rates are for informational purposes and are not guaranteed.
Compliance Advice: QuoteDeck does not provide legal, tax, or regulatory advice. Users are solely responsible for ensuring compliance with CMS, DOI, TCPA, and CAN-SPAM regulations.
HIPAA Status: QuoteDeck provides a HIPAA-Ready Platform designed to assist insurance agencies in maintaining compliance. QuoteDeck operates as a Business Associate for our users who are "Covered Entities" or "Business Associates." We maintain a signed Business Associate Agreement (BAA) with our primary infrastructure providers (AWS).
Technical Safeguards: The Platform employs industry-leading technical safeguards, including AES-256 encryption at rest, TLS 1.3 encryption in transit, and mandatory Multi-Factor Authentication (MFA), to protect Electronic Protected Health Information (ePHI).
Shared Responsibility: While QuoteDeck provides a secure environment, Users are solely responsible for obtaining necessary HIPAA Authorizations from clients, managing internal Role-Based Access, and providing clients with a Notice of Privacy Practices (NPP) as required by the February 2026 HIPAA Privacy Rule updates.
QuoteDeck retains exclusive ownership of all intellectual property, code, and features. You agree not to copy, modify, reverse engineer, or attempt to extract the source code of the Platform.
You are solely responsible for your use of the Platform, all User Content submitted, and maintaining proper professional licenses. You warrant that all User Content is accurate and that you have the right to submit it.
You retain ownership of your User Content but grant QuoteDeck a license to use and store it solely to operate the Platform. QuoteDeck reserves the right to remove any content that violates this Agreement.
You agree not to disrupt the Platform's security, use automated bots to harvest data, share credentials, or use the Platform to build a competing service.
We are not responsible for the practices of third-party services integrated with the Platform. Your use of these services is subject to their respective terms.
We do not guarantee 100% uptime. We reserve the right to modify or discontinue any portion of the Platform at any time.
You may terminate your account at any time. QuoteDeck may suspend access immediately for violations of this Agreement.
Data Retention After Termination: When your subscription is cancelled, lapses for non-payment, or is otherwise terminated, QuoteDeck retains your account data for 30 days so you can reactivate or retrieve it. We will email you when this period begins, again seven days before it ends, and once more the day before. At the end of that 30-day period your account and its data — including clients, quotes, policies, submitted forms, communications history, and uploaded documents — are permanently deleted and cannot be recovered. Reactivating your subscription within the 30 days cancels the deletion. Billing records and anonymized access logs are kept as described in our Privacy Policy.
Your Own Records: Licensed agents may have independent record-keeping obligations for client files. Exporting or saving anything you are required to keep before the 30-day period ends is your responsibility.
THE PLATFORM IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. QuoteDeck does not warrant that the Platform will be error-free or that quotes generated are current or accurate.
QUOTEDECK SHALL NOT BE LIABLE FOR INDIRECT OR CONSEQUENTIAL DAMAGES. Our total liability shall not exceed the amount you paid in the 12 months preceding the claim or $100, whichever is greater.
You agree to indemnify QuoteDeck against any claims arising from your use of the Platform, your violation of this Agreement, or your violation of third-party rights.
Any dispute shall be resolved through binding arbitration administered by the AAA in Wilmington, Delaware. You waive any right to participate in class actions. You may opt out within 30 days of first accepting this Agreement.
This Agreement is governed by the laws of the State of Delaware, United States.
Your use of the Platform is also governed by our Privacy Policy, which is incorporated here by reference.
This Agreement constitutes the entire agreement between you and QuoteDeck. If any provision is found unenforceable, the remaining provisions remain in effect.
